Tomson bvba is reachable by telephone on weekdays from 9.00 am till 17.00 pm.

1.1 In these terms we mean by 'Tomson': Tomson bvba, also trading under the name Multipot, Multipot.eu

1.2 User: Any natural person or legal entity whatsoever who is or will be in a contractual relationship of any kind with Tomson.

2. General

2.1 In addition to the described Terms & Conditions, Tomson can handle different conditions, specifically on the type of transaction or type of order/product. If there are differences between the additional conditions and the Terms & Conditions, then the provisions of the additional conditions are above those of the Terms & Conditions, unless specified otherwise.

2.2 The Terms & Conditions apply to Tomson and everyone who puts orders with Tomson.

2.3 Tomson reserves the right to change the Terms & Conditions and/or add supplements for future orders at any time.

2.4 By using a Tomson website and/or placing an order, the User accepts the Terms & Conditions and all other rights and duties stated on this site.

2.5 The Terms & Conditions applied by the user do not apply.

3. The offer

3.1 The offer on the site contains sufficient detailed information on the nature of the products and/or services. Each offer contains enough information for the User so that the latter is clear what his rights and obligations involved in accepting the offer. Mistakes or errors in the offer do not bind the entrepreneur. Despite the great care with which the website has been created, Tomson cannot be held responsible for errors and/or mistakes which have crept into the website.

3.2 Article 3.1 includes, in particular:

- The price, expressed in euros, excluding VAT, possibly including Recupel and other surcharges.

- Any shipping costs.

4. The Agreement

4.1 The agreement is valid once the User has placed the order, and is confirmed by an order confirmation Emailed to an address specified by the user.

4.2 The User and Tomson expressly agree that an agreement made by making use of electronic communication is valid, and that the absence of a written signature does not affect the binding effect of the acceptance of the offer.

5. Right of withdrawal

5.1 Following the acceptance of the offer, the purchase of a product and/or the provision of a service, the consumer always has the option to terminate the agreement without giving any reason, within fourteen (14) days. This period starts on the day after the User has received the product and/or the time at which the service is accepted. When the last day of that period does not fall on a workday, the next business day applies as the last day of the period.

5.2 There is an exception to Article 5.1, so the User no longer has the right to cancel the purchase. This is the case when the articles are damaged or incomplete, and/or when obvious signs of use are present.

5.3 In case of withdrawal the User is charged with the cost of the return.

5.4 In case of withdrawal, if the user has made a payment, a refund is implemented as soon as possible and no later than thirty (30) days after receipt by Tomson of the returned product or the withdrawal of the service.

6. Delivery

6.1 Orders will be shipped as soon as possible, we aim to ship orders within two days after receipt of payment. Unless otherwise agreed, the final delivery date is thirty (30) days after receipt of payment, unless a different delivery period was agreed. If the User does not receive his product in accordance with the preceding conditions, he has the right to terminate the contract without penalty.

6.2 Deliveries are made to the shipping address provided by the User, specified at the conclusion of the agreement.

6.3 Once the products are delivered at the specified delivery address (Article 6.2), the risk that rests on the products is transferred to the user.

6.4 If it is not possible to supply all products at the same time (for example in case a part of the products are not in stock), than Tomson may decide to carry out the delivery in several times.

6.5 When the product is harmed during transportation thereof to the user, the cost to repair or provide a new product is for the account of Tomson.

7. Defects and complaints

7.1 Upon acceptance of delivery of the products, the User must inspect the products accurately. Complaints from the User concerning delivery, which must be externally visible, should be put in writing by the buyer within seven (7) days after delivery to Tomson.

7.2 In case of complaints, the customer can always contact Tomson, we try to help as much as possible. Complaints must be described clearly and in detail and should be sent to us via email or in writing.

8. Warranty

8.1 We follow the legal provisions concerning warranty, laid down in the Belgian legislation.

8.2 Guarantee in addition to the statutory provisions is not provided in the following cases:

- If wear and tear of the product can be regarded as normal.

- If changes are made to the product, such as repairs, without permission of Tomson or the product manufacturer.

- If no original invoice can be submitted, if it is changed or (partially) defaced.

- When defects are caused by not corresponding or improper use of the product.

- When defects are caused by intentionally damage, great negligence or improper maintenance.

- When defects are caused by use of faulty units or third party products.

9. Privacy

9.1 By using this site Tomson, the User agrees to the Privacy Policy, which can be found on the site.
